AS-IS / AS-AVAILABLE
THE SERVICE, INCLUDING ALL CONTENT, FEATURES, SOFTWARE, INFRASTRUCTURE, ANALYTICS, RECOMMENDATIONS, EMBEDS AND ANY RELATED MATERIALS, IS PROVIDED "AS-IS" AND "AS-AVAILABLE", WITH ALL FAULTS AND DEFECTS, WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted by Applicable Law, the Operator expressly disclaims every warranty whether express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, currency, security, error-free or uninterrupted operation, immunity from malware or unauthorised access, achievement of any particular result, conformity with description or sample, satisfactory quality, and quiet enjoyment.
No oral or written information given by the Operator, its employees, contractors, sub-processors or affiliates shall create any warranty not expressly stated in these documents. Statements made on the Operator's website, in marketing material, in customer-support correspondence or in onboarding flows are for general informational purposes only and shall not be construed as warranties.
No uptime guarantee
The Operator makes no guarantee, representation, commitment or warranty that the Service or any feature thereof will be available, complete, accurate, timely, secure, free of error or interruption, or compatible with any device, browser, network, codec, player, operating system or third-party integration. Without limitation:
- The Operator does not commit to any specific uptime percentage; no service-level agreement is granted under the standard plans;
- Scheduled maintenance, security patches, infrastructure migrations and database upgrades may interrupt the Service at any time without prior notice;
- Upstream incidents (cloud, CDN, network operator, sub-processor, payment provider) may cause partial or complete unavailability of the Service for which the Operator is not responsible;
- Regional connectivity issues, peering disputes, BGP route changes, ISP throttling and undersea-cable outages may degrade access in particular geographies;
- Distributed denial-of-service attacks, botnet activity, traffic abuse and law-enforcement action may interrupt the Service without compensation;
- Regulatory or court orders may require the Operator to suspend, geo-block, age-gate, watermark or de-list any User Content with immediate effect.
The User accepts the foregoing risks in full and waives any claim against the Operator for loss arising from any service interruption.
No data-security guarantee
Despite the implementation of reasonable industry-standard safeguards (TLS in transit, encrypted storage at rest, hashed passwords, scoped access controls, continuous monitoring, periodic third-party security review), the Operator does not warrant that the Service is secure, that data will not be lost or corrupted, or that unauthorised access will not occur. Users are solely responsible for:
- Keeping their own copies of source files, credentials, API keys and access tokens;
- Selecting strong, unique passwords and enabling two-factor authentication on their Account;
- Maintaining the security of their own devices, networks and back-up procedures;
- Notifying the Operator immediately at [email protected] upon becoming aware of any unauthorised access, suspected breach, lost credentials or change in beneficial ownership.
The Operator is not liable for the loss, alteration, exposure, disclosure or unavailability of any User data, whether caused by hardware failure, software defect, network incident, third-party act, force majeure, social engineering, credential reuse, or human error of the User. The Operator's obligations in respect of personal data are set out in the Privacy Policy.
No professional advice
Nothing on the Service constitutes legal, tax, accounting, medical, psychological, financial, investment, immigration, broadcasting, regulatory or other professional advice. Information presented on the platform — whether in articles, FAQ entries, video descriptions, dashboard tooltips, support correspondence or otherwise — is for general informational purposes only. You must obtain advice from a qualified professional in your jurisdiction before relying on anything you find on or through the Service. The Operator is not authorised or regulated to provide any form of professional advice.
No endorsement of User Content
The presence of any User Content, advertisement, third-party link, integration, badge, ranking, recommendation, "trending" indicator or testimonial on the Service does not constitute an endorsement, sponsorship, recommendation, ratification, vouching for, or warranty by the Operator. The Operator does not pre-screen, review, edit, ratify, sponsor or endorse any User Content; views, opinions and statements expressed in User Content are those of the respective Users alone. Reliance on User Content is at your own risk.
Third-party material
The Service may include or interoperate with third-party software, libraries, APIs, fonts, data, advertising networks, payment processors, anti-fraud providers, KYC providers, analytics providers and content-delivery networks. Use of those components is governed by the respective third party's terms; the Operator is not responsible for their availability, behaviour, accuracy, security, privacy practices, or compliance with Applicable Law. Where a third-party service requires acceptance of additional terms, the User accepts those terms as a condition of use.
External links
The Service may contain links to external websites or resources, including in User-supplied descriptions, embed origins, and advertising creatives. The Operator has no control over and accepts no responsibility for the availability, accuracy, content, security or practices of those external resources. Inclusion of a link is not an endorsement and the Operator does not adopt or vouch for any content reachable through any external link.
Beta & experimental features
The Operator may from time to time make available "beta", "preview", "alpha" or "experimental" features. Such features are provided strictly "AS-IS", may be unstable, may produce inaccurate output, may be modified, withdrawn or discontinued at any time without notice, and are excluded from any service-level commitment. The Operator's total liability in respect of any beta feature is limited to USD 0. Use of beta features is at the User's own risk.
Geographic availability
The Service is offered globally subject to the User's compliance with local law and with the sanctions and export-control regimes set out in the Terms of Service. The Operator does not warrant that the Service, or any feature, content or payout method, is available in every jurisdiction. The Operator may, at its sole discretion and without notice, restrict access to the Service or to any feature in any jurisdiction where such restriction is required by law, sanctions, court order or operational necessity. The User is responsible for confirming the lawfulness of access from the User's location.
Streaming quality
The Service uses adaptive HLS bitrate switching to deliver the highest sustainable quality given the User's network conditions, device capabilities and selected playback profile. The Operator does not guarantee any specific resolution, bitrate, latency, frame rate, audio quality, codec support, subtitle synchronisation, or absence of buffering. Quality may degrade where the User's network is congested, where peering is sub-optimal, where the User's device is constrained, or where upstream content-delivery networks are impaired.
CDN & caching
Files are distributed via global content-delivery networks operated by third parties. Cached copies may persist on edge nodes and in viewer browsers for periods determined by HTTP cache directives, third-party CDN policies and viewer device behaviour. The Operator does not control the timing of cache expiry on third-party networks or in viewer browsers and is not responsible for the continued availability of cached content after a takedown, deletion or geo-restriction has been applied at the origin. Removal of content from the origin does not retroactively remove cached copies that have already been served.
Analytics, metrics & projections
All metrics shown on the Service (including views, qualified views, watch-time, engagement signals, CPM, EPM, balance, projections, tier indicators, geographic breakdowns, device-class breakdowns and traffic-source attribution) are provided for informational purposes only and may be re-stated, recalculated, re-attributed or reversed at any time as a result of fraud-prevention review, third-party reporting adjustments, currency revaluation, technical correction or methodology change. Past performance is not indicative of future results. Projections, forecasts and estimates are inherently uncertain; the Operator makes no commitment that any forecast will be achieved.
Earnings disclaimer
The Operator does not promise, guarantee, project or represent any specific level of revenue, audience, growth, virality or commercial success. Headline tier rates ("up to $X per 10k views") describe the maximum gross rate of the top tier under ideal conditions and are not a forecast for any individual creator. Actual revenue depends on viewer geography, traffic quality, content category, demand for ad inventory, exchange rates, the Operator's anti-fraud determinations, and many other variables outside the Operator's control. Cyber-attack & abuse
Despite the Operator's reasonable defensive measures, the Service may be subject to cyber-attacks, including denial-of-service attacks, credential-stuffing campaigns, account-takeover attempts, BGP hijacks, DNS hijacks, supply-chain compromises, social engineering and zero-day exploitation of third-party components. The Operator is not liable for any loss, interruption, data exposure or other harm caused by such attacks, regardless of whether the Operator could have prevented the attack. Users are responsible for configuring strong authentication, monitoring their own activity, and acting promptly on any anomaly.
Assumption of risk
You knowingly and voluntarily assume all risks associated with using the Service, including without limitation:
- Technical risk — outages, latency, data loss, corruption, security incidents, interoperability failures.
- Commercial risk — no revenue, charge-backs, demonetisation, balance reversal, policy changes.
- Legal risk — regulatory enquiry, third-party claims, takedown, account closure, criminal exposure for unlawful uploads.
- Reputational risk — exposure of identity, association with controversial material, public harassment.
- Counterparty risk — interaction with other Users, viewers, third-party processors, advertisers and integrators.
- Tax & reporting risk — obligation to declare income, withholding, audit, double-taxation.
- Compliance risk — sanctions screening, export controls, anti-bribery, anti-money-laundering rules applicable to the User.
You release the Operator from every claim arising out of any of these risks to the maximum extent permitted by Applicable Law.
Limitation of liability
The disclaimers and limitations on liability in the Terms of Service apply equally to this Disclaimer and are incorporated by reference. The Operator's aggregate liability for all claims arising out of or relating to these documents or the Service is capped at one hundred United States dollars (USD 100), on a per-User lifetime basis. Nothing in this Disclaimer is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable Mandatory Consumer Law.
